12. Caveat
A caveat is a document which we can register on the title to the property giving notice to the public at large of your interest in the property as purchaser. Generally, the effect of a caveat is that the Registrar of Titles may not register any dealing affecting land without first notifying you, and it puts third parties on notice of your interest in the land.
Whilst not ordinarily necessary, the existence of a caveat may be helpful:
(a) if the title cannot be searched immediately before settlement;
(b) if the Vendor is impecunious, had unpaid debts or tries to sell the property to someone else or grant a new mortgage over the property; and
(c) if there is any delay in lodging or registration of the Transfer of Land after settlement.
We strongly recommend that a caveat in your name be registered on the title to the property protecting your rights. By doing so you will be telling anyone else who tries to deal with the property that your rights come first. If you do not have a caveat on the title there is nothing to stop the vendor from selling or mortgaging the property or someone else making a claim to it. The cost of a caveat is $291.00 and is well worth the peace of mind it offers. |
