关于那个很火的帖子,起因是builder善意提醒owner没有permit是不能开工,后来在owner的执意下开工,导致owner损失。
这里我想他也是善意提醒大家做事要有依据,但为什么在这个案例里builder本人也负有一定责任。我想还是有必要给大家解释清楚。以免连行业内的人的提醒也成了攻击的靶子。
首先Builder一定是有牌照的(Registered Building Practitioner).
Building Practitioner是受相关法律文件约束的 The Building Act 1993.
以下是我咨询Building Commission 此案例后的答复,
Section 16 of the Building Act states that " a person must not carry out building work unless a building permit in respect of the work has been issued..." therefore the builder who carried out the building work prior to a building permit being issued is in breach of the Building Act.
An inquiry can also be held by the Building Practitioners Board into the conduct of the registered building practitioner.
The owner of the property can also have enforcement action taken against them for allowing building work to be carried out on their property without ensuring the appropriate permits were in place.
顺便贴个没有拿到permit的building practitioner被处罚的案例。
这里奉劝大家不懂去咨询下相关部门,在这里不懂装懂,甚至嘲讽搞人身攻击木意义。
