56.1 To the extent this condition conflicts with any other condition of the contract, special condition 56 applies.
56.2 The purchaser may pay the 10% deposit on the purchase price of $X80,000, being $X8,000, by instalments, as follows:
(a) $X200.00 being 0.25% of the purchase price to the vendor’s agent as stakeholder on or before the date of this Contract
(b)$X5,800.00 being the balance of the deposit to the vendor’s agent as stakeholder on or before the end of the seventh business day after the date of this Contract.
56.3. Anytime and without cause before the end of the seventh business day after the date of this Contract, the purchaser may give notice in writing to the vendor that the purchaser rescinds the contract, but the vendor is then entitled to retain the $X,200.00 portion of the deposit.
56.4 If the purchaser fails for any reason to pay the deposit balance of $X5,800.00 by the due date, or if any cheque from the purchaser is dishonoured, the vendor may
(a) by notice in writing effective immediately upon receipt by the purchaser, rescind the contract and retain the $X,200.00 portion of the deposit, or
(b) only if the purchaser has not by the end of the seventh business day after the date of this Contract given notice in writing to the purchaser of the purchaser’s intention to exercise their ‘cooling off’ rights according to 56.3 above: rescind the contract but require the purchaser to pay the $X5,800.00, being the balance of the deposit, to the vendor in the form of liquidated damages.
