Because you signed the contract and you have the liability of paying the work they've done to you.
If you do not want to go ahead...what you are expecting is that they will probably bill you for whatever they've done (design the plan, draft up storm water plan & landscaping plan, prepare for the council approval & other admin cost). You will have to pay the balance of the 5% deposit and the bill.
You can't, however, make use of this DA approval because the builder owns this plan's copyright.
Unfortunately, you should have thought of all these things before you sign the contract.

Sorry, I don't mean to scare you. But this can potentially happen. If the builder is nice, builder might let you off. Well...you can't really rely on the "luck", can you?
