7 O' w% e, d, NBy way of background information the ACCC is an independent statutory authority responsible for the administration of the Competition and Consumer Act 2010 (the Act) which is designed to encourage fair trading and discourage anti-competitive conduct through a specific set of competition and consumer protection rules. The Act incorporates consumer protection provisions that are administered by the ACCC, together with state fair trading offices and the Australian Securities and Investment Commission, offering a uniform consumer protection law across Australia. This uniform legislation is collectively known as Australian Consumer Law (ACL).: Z% ^2 ]2 Y, h: a6 B; I

The matter you have contacted us about may raise issues in respect of the provisions of the ACL. Those provisions include a prohibition of conduct in trade or commerce that is misleading and deceptive or is likely to mislead or deceive. For this reason I have recorded your complaint in the ACCC’s national database.! q8 p* u1 Z7 w# j' A1 p7 P2 t7 m

In general the ACCC deals with complaints at a national level or those affecting many consumers. Local fair trading or consumer affairs agencies are best placed to assist with localised or individual disputes and can suggest a range of strategies that you may wish to explore to resolve your concerns. They can also provide information on how to make a claim through the small claims court or tribunal should this become necessary. Finally, they can conduct their own investigation if they have evidence of systematic breaches of their legislation.

Please note that your matter is also important to the ACCC as it assists us in determining issues with national or wider public interest implications. We closely study the patterns of complaints that we receive to ensure that our enforcement and education actions are focused on the areas of greatest concern to Australian consumers.
