190被拒，求助

楼主递交的是Offshore 190 所有没有上诉权利
要求补材料或者解释是签证官的权利 不是他/她必须要这样做
除非找出签证官的错误 否则海外递交的技术移民移民被拒没有太多其他办法

大家提到的Court的途径 理论上可行 但是没有确凿的把握 当事人和律师都需要慎重 重点是看签证官到底错了没有 错在哪里

是，这个确实是我太相信中介了，而中介也持续他们的惯性思维，以往都这样所以觉得没有风险。
其实早该准备好资料的，唉~

是哪家中介啊？楼主真是被他们害了，这种水平的中介真应该公布出来好让大家提防。前面有位网友说得对，干嘛不早点上传材料呢？等签证官要求才上传，人家觉得你不够诚意呢。我们DIY的都是早早就上传的，除非漏了什么才等CO要求。

这个case如果他们补救不好，我会公布中介名字，确实太相信他们了。是个大中介呢！
后悔莫及！

拒信如下：
You claimed to have been employed in your nominated skilled occupation or a closely related
skilled occupation for a period totalling at least 8 years.
For employment to be considered ‘skilled’, it must meet two requirements, that the
employment was undertaken after the applicant met the entry level requirements for that
occupation (that is, completed a sufficient level of study or amount of on the job training) and
that the employment involves duties relevant to the occupation and at the level of depth and
complexity expected in Australia.
In assessing both factors, case officers should have regard to ANZSCO.
The job description for a Program or Project Administrator 511112 as defined by ANZSCO
states:
developing, reviewing and negotiating variations to contracts, programs, projects and services
responding to inquiries and resolving problems concerning contracts, programs, projects,
services provided, and persons affected
managing paperwork associated with contracts, programs, projects and services provided working with Project Managers, Architects, Engineering Professionals, owners and others to ensure that goals are met advising senior management on matters requiring attention and implementing their decisions overseeing work by contractors and reporting on variations to work orders
preparing and reviewing submissions and reports concerning the organisation's activities
collecting and analysing data associated with projects undertaken, and reporting on project
outcomes reviewing and arranging new office accommodation
This occupation has a level of skill commensurate with AQF Associate Degree, Advanced
Diploma or Diploma and at least three years of relevant experience may substitute for the
formal qualifications listed above. In some instances relevant experience and/or on-the-job
training may be required in addition to the formal qualification.
According to the information provided with your application, you hold a Master of Science
awarded in 2008 by Columbia University. The skills assessing authority who made an
assessment of your qualifications and work experience in your nominated occupation, states
that the qualification above is not in a highly relevant field of study. It further states that if
the qualification is not in a highly relevant field, two years of employment at an appropriate
skill level, completed in the last years five years which is highly relevant to the nominated
occupation is required. The employment provided with your skills assessment application was
deemed as highly relevant to your nominated occupation and completed at an appropriate skill
level.
With this information in mind, you are deemed qualified in your nominated occupation from
2009 after completing the two years of required work experience as outlined above.
Therefore, following an assessment of your overseas skilled employment experience I am
satisfied that you were employed in your nominated skilled occupation, or a closely related
skilled occupation, for at least 36 months in the 10 years before invitation for this visa and 5
points are awarded.

其实我头4年的工作经历也不是没有资料，在职证明，工资单等等有都，只是推荐信没有上传。CO现在是单单参考了职业评估（只评最近5年）就妄下了定论，还扣除研究生毕业后的头两年工作经历认为我还不够skilled，这个就是他的错误了！我01年开始工作，怎么可能到了08年还不skilled？一直从事的也是紧密相关的工作！
我准备用两条错误来投诉CO：
1。资料如果觉得不够没有给机会补交，这个与standard的流程不符，不公平；
2。妄下定论，做了片面的工作经历的打分，不够严谨认真。
大家看了拒信，有什么更好的建议吗？哎！我真该DIY或者多到论坛看看的，悔。。。

拒签信说了一点，就是你的master学位和你的提名专业并非高度相关。所以会减去你2年的相关工作算作是用2年工作时间达到符合提名专业要求的条件。
这个拒签信应该不是全部吧，感觉并没有结束的样子。
我目前得到的信息是，你claimed了8年的海外工作加分。但是看拒签信最后部分，CO只是认为你claimed5年的工作，这个是因为你用master做的职业评估还是因为别的我就不清楚了。所以， 5年减去一开始我说的2年时间，也就只有3年工作是算作海外工作的时间，也就只有5分了。所以你贴出来的拒签信部分的最后一句就是说，CO只是认为你有36个月的海外工作时间，也就是只能获得5分。
