Thank you for your submission in relation to abovementioned development application. Your submission has been registered and a copy provided to the Councillors and the responsible Development Assessment Officer.
Submissions received during the advertised neighbour notification period will be considered by the Development Assessment Officer during their assessment of the development application. Late submissions may not be considered.
The receipt of submission/s does not automatically result in the refusal of a development application. The assessment of a development application must be undertaken in accordance with all of the matters for consideration listed under Section 79C (1) of the Environmental Planning and Assessment Act 1979.
The avenue for determining development applications at Hurstville City Council is dependent on the extent of non-compliances and the number of submissions received. These avenues include:
Council Meeting – These meetings occur twice a month in the Council Chambers and are open to the public. Determinations are made by the Council following consideration of the assessment report prepared by the Development Assessment Officer, verbal representations made at the meeting by the applicant and/or submitters and following debate of the relevant issues by the Councillors.
If a development application is to be determined at a Council Meeting you will be notified of the date and time of the meeting and how to get a copy of the development assessment report. You will also be notified of the determination made by the Council.
Council Delegation (DACDEL) – An assessment report is prepared by the Development Assessment Officer and is circulated to the Councillors for consideration. The Councillors can decide to “call in” the development application for consideration as part of the Council Meeting. If a development application is not called in by a Councillor, the application is determined under staff delegation as per the recommendation in the assessment report. If a development application is to be determined under delegated authority, you will be notified once a determination has been made.
Delegated Authority - this means that the development application is determined by the Development Assessment Officer if the development application falls within their delegations. If a development application is to be determined under delegated authority, you will be notified once a determination has been made.
If an applicant chooses to lodge an appeal with the NSW Land and Environment Court before the application is determined by Council (known as a “Deemed Refusal”), the NSW Land and Environment Court replaces Council as the consent authority.
