Long service leave is state legislation. Everyone work in Australia is entitled even causal employee. The service years requirement is depend on the state.
NSW
If an employee terminate the employment e.g. resign, the employee is entitled to be paid for long service leave after 10 years continue service year
If an employer terminate the employment e.g. redundancy or dismiss except serious misconduct, the service requirement for long service leave pay out is 5 years continue service years
VIC
the long service leave pay out in VIC requires 6 continue service year for all termination reason except serious misconduct |
